DRIVING SAFETY COURSE
- The Code of Criminal Procedure, Art 45.0511 (q) states "You may be able to require that this charge be dismissed by successfully completing a driving safety course or a motorcycle operator training course. You will lose that right if, on or before your appearance date, you do not provide the court with notice of your request to take the course."
- If you have been charged with a traffic offense, you may be eligible to request the Driving Safety Course option on or before your initial appearance date.
Eligibility –
- You must have and present a valid, non-commercial Texas driver’s license.
- You must enter a plea of guilty or nolo contendere (no contest).
- You must have been charged with an eligible offense as defined by Texas Transportation Code 45.0511. (Speeding should not exceed 24 mph over the speed limit)
- You must not have completed a Driving Safety Course within the 12 months preceding the date of the offense.
- You must provide evidence of financial responsibility at the time of the request.
- You must pay the court costs at the time of the request.

School Zone Moving Violation: $169
DSC Request – in Person or by Mail by your given court date
- Submit a plea of guilty or nolo contendere (no contest).
- Submit a Valid Driver’s License.
- Sumit Valid Insurance policy with the defendant’s name listed.
- Money order or Cashier’s Check of $144.00 (if not in school zone).
Please note: You must complete the request for the driving safety course option prior to taking the course.
Requirements for Acceptance –
- You must submit an original court copy of a Driving Safety Course completion certificate from a course provider certified by the Texas Department of Licensing and Regulation.
- The certificate must be signed, must have City of Waller Municipal Court listed at the court, and must be submitted to the court on or before the 90th day indicated on your Driving Safety Course order.
- You must submit a certified (Type 3A) copy of your driving record from the Texas Department of Public Safety. Your driving record must be submitted to the court on or before the 90th day indicated on your Driving Safety Course order.
Note: You do not have 90 days to take the course. You must complete the course and submit all required documents on or before the 90th day. Failure to comply with the requirements of your Driving Safety Course order will result in a Show Cause hearing.

Extensions/Payment Plan- an Extension is a 30-day period to pay your citation. To request an extension, you may submit a plea of guilty or nolo contendere (no contest), a copy of your Driver’s License, and a good mailing address in person or by mail:
To request a payment plan or community service, you must appear before the judge by your given court date.
Compliance dismissals- You may be eligible to have your case dismissed due to compliance with the law in certain instances. Please check the compliance dismissal form to see if you qualify.
Not guilty Plea- You have a right to a jury trial unless you waive that right and request a trial by a judge. By setting your case for trial, you are giving up your right to require that your case be dismissed through a mandatory Driving Safety Course. Court Policies and Dress Code-Court Starts at 10 AM on Wednesdays. We only have court on Wednesdays. No one will be allowed in after the 30-minute mark. Please have your Driver’s license and Insurance when coming to court.
- Be on time. We are open 30 minutes before the scheduled court date for signing-in.
- No food, drinks, or gum chewing.
- Mute cell phones, pagers, and/or smartwatches
ALL PEOPLE IN THE COURTROOM MUST BE DRESSED APPROPRIATELY AND RESPECTFULLY
UNACCEPTABLE ATTIRE INCLUDES BUT IS NOT LIMITED TO:
- Shorts or cutoffs
- Muscle shirts, clothing with offensive, vulgar, racist, sexist, obscene, or suggestive words, slogans, depictions, or pictures including grotesque creatures
- Mini skirts or halter tops
- Clothing that is too tight or too short
- Clothing that is dirty, torn, or ragged
- Hats and caps
